www.mktstudio.com (the ""Site"") is published by JANN-K CREATIONS, a French simplified joint-stock company (SAS) with share capital of €100,000, whose registered office is located at 23 quai de la Seine, 75019 Paris, France, registered with the Paris Trade and Companies Register (RCS) under number 532 625 886. SIRET 532 625 886 00108. Member of a single VAT entity – applicable VAT number: FR44 100 735 513 – AU: MVA (hereinafter ""JANN-K CREATIONS"").

I - Application of the Terms and Conditions of Sale

The terms and conditions of sale set out below (the ""Terms"") apply to all orders for products and services placed via the Site (the ""Products"") with JANN-K CREATIONS by any person (the ""Customer"").

The Customer must read the Terms before placing any order (the ""Order""). The Terms are available on the Site.

JANN-K CREATIONS reserves the right to adapt or amend these Terms at any time. The version of the Terms applicable to any sale is the one published on www.mktstudio.com at the time of the Order. Accordingly, placing an Order implies the Customer's full, prior and unreserved acceptance of these Terms.

II - Information about the Site and accessibility

www.mktstudio.com is an e-commerce website owned and operated by JANN-K CREATIONS.

The Site is open to all internet users and is in principle accessible 24 hours a day, 7 days a week, except in the event of scheduled or unscheduled interruption by JANN-K CREATIONS or its service providers for maintenance purposes or in the event of force majeure (as defined herein). JANN-K CREATIONS cannot be held liable for any damage of any kind resulting from the Site being unavailable.

JANN-K CREATIONS does not guarantee that the Site will be free of anomalies, errors or bugs, or that the Site will operate without failure or interruption. It may freely determine, at its sole discretion, any period during which the Site or its content is unavailable. JANN-K CREATIONS cannot be held liable for data transmission, connection or network availability problems.

III – Customer account

The Customer may place an Order with or without creating a customer account (the ""Account""). The Account allows the Customer, in particular, to track Orders, view invoices and submit return requests.

When placing an Order or creating an Account, the Customer must ensure that the information provided is accurate and complete and undertakes to keep it up to date. In the event of an error in the recipient's details, JANN-K CREATIONS cannot be held liable if the Products cannot be delivered.

By placing an Order on the Site, the Customer represents and warrants to JANN-K CREATIONS that they are of legal age and have the legal capacity to enter into a contract.

JANN-K CREATIONS may suspend or delete a Customer's Account if the Customer breaches these Terms or uses the Site fraudulently.

IV - Products

The Products offered for sale are those described on the Site on the day the Customer visits the Site, while stocks last. This information is updated automatically in real time. However, an error in updating, whatever its cause, does not engage the liability of JANN-K CREATIONS.

JANN-K CREATIONS takes the utmost care in presenting and describing the Products in order to inform the Customer as accurately as possible. However, errors may appear on the Site, which the Customer acknowledges and accepts.

JANN-K CREATIONS does not guarantee the accuracy or security of information transmitted or obtained through the Site.

Following an Order, the Customer may receive an item previously returned by another person. JANN-K CREATIONS only accepts the return of intact and unworn Products, and both conditions are checked before returned Products are put back into stock.

V - Orders

Orders placed on the Site are subject to the procedure set up by JANN-K CREATIONS, which consists of successive steps leading to the validation of the Order.

The Customer may select as many Products as they wish, which will be added to the shopping cart (the ""Cart""). The Cart summarizes the Products selected by the Customer as well as the related prices and costs. The Customer may freely modify the Cart before validating the Order. Validation of the Order constitutes the Customer's acceptance of the Terms, the Products purchased, their price and the associated costs.

A confirmation email summarizing the Order (products, prices, availability, quantity, etc.) is sent to the Customer by JANN-K CREATIONS. The Customer expressly accepts the use of email for the confirmation of the content of their Order. Invoices are available in the ""My account"" section of the Site.

VI – Refusal to process an Order

JANN-K CREATIONS reserves the right to withdraw any Product displayed on the Site at any time and to replace or modify any content or information on the Site. Despite JANN-K CREATIONS' best efforts to meet its customers' expectations, it may have to refuse to process an Order after sending the Customer the Order confirmation email. In this case, any amounts paid are refunded to the Customer in full.

JANN-K CREATIONS cannot be held liable to the Customer or any third party for deciding to withdraw a Product from the Site, to replace or modify any content or information on the Site, or to refuse to process an Order after the Order confirmation email has been sent.

VII - Prices and payment terms

Product prices are shown on the Site in euros, all taxes included.
All prices displayed include the value added tax (VAT) applicable in France, which may differ depending on the billing country.
JANN-K CREATIONS reserves the right to change its prices at any time, but Products are invoiced at the prices in force when the Order is recorded, subject to availability.
Products are payable in full when the Order is placed.

Payment is made via the secure payment platform Shopify Payments (Cartes Bancaires, Visa, Mastercard, American Express, Apple Pay, Shop Pay, PayPal, Klarna, Bancontact, EPS, iDEAL | Wero, MobilePay) or in instalments via Scalapay, depending on the payment methods offered at the time of the Order. The Customer expressly acknowledges that providing their payment details authorizes the debit of their account for the price of the Products ordered. Where applicable, a notice of Order cancellation for non-payment is sent to the Customer by JANN-K CREATIONS at the email address provided when placing the Order.

The data recorded and stored by JANN-K CREATIONS constitutes proof of the Order and of all sales made. The data recorded by the payment service providers (Shopify Payments, PayPal, Klarna, Scalapay) constitutes proof of any financial transaction between the Customer and JANN-K CREATIONS.

VIII - Delivery

Deliveries are made by Colissimo (La Poste), Monday to Saturday, according to the option chosen by the Customer when validating the Order:

• Colissimo Point Retrait (France)
• Colissimo home delivery with signature (France and Europe)
• Colissimo Expert International (rest of the world)

The shipping rates applicable to each destination country are shown on the Site and summarized in the Cart before the Order is validated.

Delivery means the transfer to the Customer of physical possession of the Products (the ""Delivery"").

When JANN-K CREATIONS arranges the transport of the Product, the risk of loss or damage to the Product passes to the Customer upon Delivery. By way of exception, the risk passes to the Customer when the Product is handed over to the carrier if the carrier was chosen by the Customer and not offered by JANN-K CREATIONS.

Delivery is made to the delivery address provided by the Customer, which must be the Customer's residential address, that of a natural person of their choice or of a legal entity (delivery to their workplace), or the pickup point chosen by the Customer.

If Delivery cannot be made, the carrier leaves a notice at the delivery address stating where the Product is and how to collect it. If the Product is not collected within the time allowed, it is returned to the JANN-K CREATIONS warehouse. The Customer may contact JANN-K CREATIONS to arrange a new Delivery.

JANN-K CREATIONS delivers Orders within a maximum period, in principle, of 15 (fifteen) business days for Delivery in metropolitan France and 20 (twenty) business days for international Delivery, counted from the day following validation of the Order. On the day following the launch of a collection, the Delivery period may be extended by 10 (ten) days due to the volume of Orders.

To ensure these timeframes can be met, the Customer must provide accurate and complete information regarding the Delivery address (in particular: street number, building, staircase, access codes, intercom names and/or numbers, etc.).

JANN-K CREATIONS cannot be held liable for a delay in transport that is not attributable to it or that is due to force majeure (as defined below).

If the Delivery period is exceeded, the Customer may request cancellation of the sale and obtain, within a maximum of 14 (fourteen) days of such request, a refund of all sums paid in connection with the Order.

Colissimo parcels delivered against signature are handed over using a 6-digit confidential code sent by email before delivery (as digits and as a barcode). At the time of delivery, the Customer may have the barcode scanned or give the code directly to the courier. Scanning the code constitutes proof of delivery.

Please note: for any delivery outside the European Union (in particular Switzerland, the United Kingdom, Norway and countries in the international zone), customs duties and local taxes may be charged to the Customer upon receipt of the Order.

IX - Right of withdrawal, returns and refunds

Withdrawal period. In accordance with Articles L.221-18 et seq. of the French Consumer Code, consumer Customers have 14 (fourteen) days from receipt of the Products to exercise their right of withdrawal, without having to give any reason or pay any penalty, with the exception of the return fees mentioned below.

Exercising the right of withdrawal. The Customer exercises the right of withdrawal:
• by submitting a request on our returns portal: https://mktstudio.shipping-portal.com/rp/ (also accessible from the Account, under ""Request a return"");
• or by sending the model withdrawal form set out in the appendix to these Terms;
• or by any other unequivocal statement sent to contact@mktstudio.com.
JANN-K CREATIONS acknowledges receipt without delay on a durable medium.

Returning the Products. The Customer must return the Products no later than 14 (fourteen) days after communicating the decision to withdraw, to the following address: JANN-K CREATIONS – MKT STUDIO – UM LOG, 2 rue Magnier Bedu, Bâtiment D, 95410 Groslay, France. The invoice must be included in the parcel. Products must be returned unworn, unwashed, in perfect condition and with their original tag. Full details are available on the ""Refund policy"" page of the Site.

Return fees.
• Metropolitan France: €3, deducted from the refunded amount;
• Belgium and Spain: €4.90, deducted from the refunded amount;
for these three countries, the parcel is dropped off at a Chronopost (Shop2Shop) pickup point using the label provided via the returns portal.
• Other countries: returns are not handled by the returns portal. The Customer returns the Products by their own means and at their own expense; a tracked shipment is recommended.
The return of a defective or non-conforming Product is free of charge (see Article X).

Exchanges. JANN-K CREATIONS does not offer exchanges: only refunds are available. Customers wishing to obtain a different size or style may place a new Order.

Refunds. JANN-K CREATIONS refunds the Customer within a maximum of 14 (fourteen) days from the date on which it is informed of the Customer's decision to withdraw. JANN-K CREATIONS may withhold the refund until it has received the Products back or until the Customer has supplied proof of having sent them, whichever is the earliest. Unless the Customer expressly agrees to another method, the refund is made using the same payment method as that used for the initial transaction.

Original shipping costs are not refunded, except in the case of a defective or non-conforming Product.

An Order paid with a gift card or store credit is refunded as store credit.

Loss in value. If a Product is returned worn, washed, damaged or incomplete, the Customer may be held liable for any loss in value of the Product resulting from handling other than what is necessary to establish its nature, characteristics and functioning. The refunded amount may then be reduced by the amount of the loss in value observed.

X - Warranties - Limitation of liability

To the extent permitted by law, the liability of JANN-K CREATIONS in respect of any Product purchased on the Site is limited to its purchase price. JANN-K CREATIONS shall under no circumstances be liable for the following losses, whatever their origin:

• loss of revenue or sales
• operating loss
• loss of profits or contracts
• loss of anticipated savings
• loss of data
• loss of working or management time
• damage to reputation
• loss of opportunity
• non-pecuniary damage.

This limitation does not apply to the legal guarantees of conformity and against hidden defects described below, which the Customer benefits from in all cases.

JANN-K CREATIONS is required to deliver Products that conform to the contract, meaning in particular that they match their description and the characteristics presented on the Site, are fit for the purposes for which products of the same type are normally used, and have the qualities a Customer may legitimately expect.

Defect noticed upon receipt

The Customer is invited to report any visible defect as soon as possible via our contact form or by email to contact@mktstudio.com, describing the defect and, if possible, attaching a photo. This does not affect the Customer's right of withdrawal or the legal guarantees described below.

Implementing the legal guarantees

To implement the legal guarantee of conformity or the guarantee against hidden defects, the Customer reports the defect to customer service (via our contact form or by email at contact@mktstudio.com) and then returns the Product, together with the Order references, via the returns portal, selecting the reason ""defective product"". The return is free of charge for the Customer.

Legal guarantee of conformity

The consumer has a period of two years from delivery of the goods to obtain the implementation of the legal guarantee of conformity if a lack of conformity appears. During this period, the consumer only has to establish the existence of the lack of conformity and not the date on which it appeared.

The legal guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of their request, free of charge and without major inconvenience to them.

If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee.

If the consumer requests repair of the goods but the seller imposes replacement, the legal guarantee of conformity is renewed for a period of two years from the date of replacement of the goods.

The consumer may obtain a reduction in the purchase price while keeping the goods, or terminate the contract and obtain a full refund upon return of the goods, if:
1° The seller refuses to repair or replace the goods;
2° The repair or replacement of the goods takes place after a period of thirty days;
3° The repair or replacement of the goods causes major inconvenience to the consumer, in particular where the consumer permanently bears the costs of taking back or removing the non-conforming goods, or bears the costs of installing the repaired or replacement goods;
4° The lack of conformity persists despite the seller's unsuccessful attempt to bring the goods into conformity.

The consumer is also entitled to a price reduction or termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination. In this case, the consumer is not required to request repair or replacement of the goods beforehand.

The consumer is not entitled to terminate the sale if the lack of conformity is minor.

Any period during which the goods are immobilized for repair or replacement suspends the remaining guarantee period until the repaired goods are delivered.

The above rights result from the application of Articles L.217-1 to L.217-32 of the French Consumer Code.

A seller who in bad faith obstructs the implementation of the legal guarantee of conformity is liable to a civil fine of up to €300,000, which may be increased to 10% of average annual turnover (Article L.241-5 of the French Consumer Code).

Legal guarantee against hidden defects

The consumer also benefits from the legal guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code, for a period of two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund upon return of the goods.

Article 1641 of the French Civil Code: ""The seller is bound by a warranty against hidden defects in the thing sold which render it unfit for the use for which it was intended, or which so impair that use that the buyer would not have acquired it, or would only have paid a lower price for it, had they known of them.""

Article 1648, paragraph 1 of the French Civil Code: ""An action resulting from latent defects must be brought by the purchaser within two years of the discovery of the defect.""

Force majeure

If an event of force majeure prevents the performance of these Terms, JANN-K CREATIONS will inform the Customer within fifteen (15) days of the occurrence of the event, by email or by registered letter with acknowledgment of receipt. In addition to those usually recognized by the case law of French courts, the following are expressly considered cases of force majeure or unforeseeable circumstances: total or partial strikes, lock-outs, riots, boycotts or other industrial actions or commercial disputes, civil unrest, insurrections, wars, bad weather, epidemics, blockages of means of transport or supply for any reason whatsoever, earthquakes, fires, storms, floods, water damage, governmental or legal restrictions, legal or regulatory changes to forms of marketing, computer failures, blockages of telecommunications, including wired or wireless telecommunications networks, and any other event beyond the control of the parties preventing the normal performance of the contractual relationship. All obligations of the parties are suspended for the duration of the force majeure event, without compensation. If the force majeure event lasts for more than three (3) months, the transaction concerned may be terminated at the request of JANN-K CREATIONS or the Customer, without compensation on either side. Non-payment by the Customer cannot be justified by force majeure.

XI – Partial invalidity

If one or more provisions of these Terms are held to be invalid or declared as such pursuant to a law, a regulation or a final decision of a competent court, the other provisions shall remain in full force and effect.

XII – No waiver

No tolerance, inaction or inertia on the part of JANN-K CREATIONS shall be interpreted as a waiver of its rights under the Terms.

XIII – Applicable law – Mediation – Jurisdiction

The sale of Products is governed by French law.

In the event of a complaint, the Customer should first contact JANN-K CREATIONS customer service via our contact form or, failing that, by email at contact@mktstudio.com.

Failing an amicable agreement, any dispute relating to the interpretation of the Terms, or to the performance or termination of a sale, shall be submitted to the courts having jurisdiction under applicable law.

Consumer mediation. In accordance with Articles L.611-1 et seq. of the French Consumer Code, consumers have the right to use a consumer mediator, free of charge, to seek an amicable resolution of any dispute with JANN-K CREATIONS. Before taking any such step, the Customer must first have tried to resolve the dispute directly with JANN-K CREATIONS by sending a written complaint to customer service.
